California Jury Awards Family $12M In Birth Injury Lawsuit

A California jury has just awarded $12.1M to the family of a boy who suffered a brain injury as the result of medical malpractice. According to reports, evidence at trial showed that Contra Costa County Health services provided negligent health care to a woman who had a high-risk twin pregnancy. Additional evidence was introduced that the family practitioner assigned to provide prenatal care to the woman was unqualified.

These errors, combined with the health care provider's delay in performing an emergency C-Section as set forth in the lawsuit caused the infant to suffer brain damage.

Where a birth injury is the result of medical negligence, it may be possible to file a claim for medical malpractice and recover damages for past and future medical expenses, lost wages and pain and suffering.

If you believe you or someone you love has suffered harm as the result of medical malpractice, consulting with an experienced San Diego personal injury lawyer right away is important to begin an investigation and determine your next steps.

Unfortunately, the consequences of negligent medical care can be devastating and last a lifetime. In this instance, the resulting brain damage has adversely affected the boy's ability to speak and has diminished his motor skills. Further, evidence was admitted that the boy would never be able to live independently or hold down a regular job. The jury estimated that the boy has a life expectancy of 74 years, and the costs associated with provided care for a lifetime would be substantial.

The monies recovered as a result of this lawsuit will be held in trust for the boy and help to improve his quality of life.
