Victims of Birth Injuries and their Families To Benefit From Medical Malpractice Reform

This past week, Senator Barbara Boxer released an ad in support of Proposition 46 – an initiative aimed at raising medical malpractice caps. Prop 46 seeks to promote justice for patients affected by medical negligence and deter physician wrongdoing by adjusting California's cap on compensation for victims of medical negligence to account for 39 years of inflation – the unadjusted cap prevent many victims from holding doctors who harm them accountable.

Other provisions of Prop 46 include becoming the first state in the country to require random drug and alcohol tests of physicians in hospitals, requiring that prescribers check California's existing statewide prescription drug database when prescribing to first-time patients, in an effort to gain control over the prescription drug epidemic.

If you have questions about medical malpractice, or believe that you or a loved one has been harmed as the result of medical negligence, it's important to consult with an experienced San Diego medical malpractice law firm right away. A skilled San Diego medical malpractice lawyer can help your family recover the compensation it deserves.

As explained by Senator Boxer, "Preventable medical errors [are] now the third leading cause of death. Only heart disease and cancer take more lives," said Senator Barbara Boxer in the television ad. "Proposition 46 will save lives with drug and alcohol testing, to make sure impaired doctors don't treat someone you love, safeguards against prescription drug abuse, and holds the medical industry accountable for mistakes."

Such reform is necessary. An unintended result of MICRA, which established the cap on non-economic damages - is that entire classes of individuals harmed by medical malpractice – such as the young, the elderly, and stay-at-home parents – have been unable to seek redress for the harm caused. Without "economic damages" such as lost wages, recovery is limited and it may not be economically feasible for these families to seek justice in court.
