Birth Injury Lawsuit Filed for Prenatal Negligence

A recently filed medical malpractice lawsuit alleges that a mother who had a history of high risk pregnancies failed to receive appropriate prenatal care, and as a result, her child suffers from a permanent birth injury. In addition to naming the medical center, a doctor and two midwives as defendants, the family is also suing the U.S. Government for its role in funding and operating the health care facility where the negligence occurred.

According to reports, the pregnant mother began receiving prenatal care at the beginning of her pregnancy. However, despite the fact the doctors and midwives in charge of her care documented her history of complications, she was scheduled for an induction. Inducing labor with Pitocin as occurred here has been linked to a higher risk of shoulder dystocia. At some point during the labor, the infant's heart rate dropped, indicating fetal distress. The physician in charge decided to peform a vacuum-assisted vaginal delivery.

The child was born with "shoulder dystocia," a condition that occurs when a baby's shoulder gets stuck behind the mother pubic bone during delivery. The child sustained serious injury to her nerve roots – a brachial plexus infjury requiring surgery. However, despite attempts to repair the damage, the child permanently lost use of her left arm.

In each of the woman's two prior pregnancies, her children suffered from shoulder dystocia increasing the likelihood that this child would suffer similar labor and delivery complications. However, despite this increased risk, the mother was never informed of the risk or presented with the option to have a Cesearan Section, which could have prevented the birth injury.

The medical malpractice and prenatal negligence lawsuit seeks damages for both the medical costs and emotional distress that occurred as the result of the failure of the physician, midwifes and other health care professionals to act with the requisite standard of care.
