Signs of Medical Malpractice

A record setting medical malpractice settlement has just been achieved on behalf of a child who suffered a catastrophic, permanent birth injury following a hospitalization at a Southern California hospital. According to reports, hospital staff failed to adequately monitor the baby's feeding tube. This failure in the standard of care caused the baby to suffer a serious brain injury requiring a lifetime of care, according to the complaint. The $20 million settlement will help pay for the child's medical expenses and required care.

When medical mistakes occur, the results can last lifetime, altering the course of a patient's life. Medical malpractice refers to situations where health care professionals – whether a doctor, nurse or other medical staff – fails to act in accordance with the requisite standard of care and a person is injured as a result. In these instances, it may be possible to file a medical malpractice lawsuit and recover damages. While not all poor outcomes are the result of medical malpractice or a medical mistake, when medical professionals breach their duty towards patients and harm occurs, they should be held accountable.

Some signs to look for in determining if malpractice occurs include an outcome that is vastly different than expected or if the treatment doesn't address the condition.
