What to do if your child has suffered a birth injury

Several complications can arise during pregnancy, or labor and delivery that may lead to the occurrence of birth injuries. Although medical negligence is certainly not always implicated, medical malpractice may exist where the birth injury is caused by a doctor, nurse or other medical staff not handling a traumatic birth properly or where a careless doctor incorrectly handles a routine birth.

For example, proper prenatal visits and examinations often reveal warning signs that a delivery will be difficult. There may be warning signs that labor and delivery will be premature, or that the labor will be prolonged. Additionally, an infant may have abnormal presentation - where the child is a breech position rather than head down. This can usually be detected via ultrasound far before the due date. Physicians and other medical staff can prepare in advance for these circumstances and know how best to respond.

Examples of errors during routine deliveries may include the failure to properly monitor a mother, the improper administration of Pitocin, and failure to respond quickly to any signs of distress.
