Caps Harm Victims of Medical Malpractice

This past week Congress passed health care legislation that would harm victims of medical negligence. HR 1215, is federal legislation that seeks to impose a cap of $250,000 on non-economic damages for those harmed by medical mistakes, now the 3rd leading cause of death in the United States. Medical mistakes include anything from prescription errors, to wrong site surgeries, to failing diagnose and treat a patient in a timely manner. If the person does not earn a high wage – often the case with children and elderly – his or her likelihood of obtaining a just recovery is impeded by caps.

Passage of this bill is another attack on patients’ rights. Statistics have shown that caps do not lead to improved health care, lowered health care insurance rates, or better patient safety.
